Agreement to Terms

By accessing or using MarleyFetch ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

MarleyFetch provides an email sending service that allows you to:

• Sign in to the dashboard
• Configure SMTP sending connections
• Send emails programmatically through the MarleyFetch API
• Manage API tokens for authentication
• View email sending logs and statistics

Account Registration

To use the Service, you must:

• Provide valid account and connection information
• Use sending credentials you are authorized to use
• Provide accurate and complete information
• Maintain the security of your API tokens

You are responsible for all activities that occur under your account and API tokens. You must notify us immediately of any unauthorized use of your account.

Acceptable Use Policy

You agree NOT to use the Service to:

• Send spam, unsolicited emails, or bulk commercial messages
• Distribute malware, viruses, or harmful content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm others
• Impersonate any person or entity
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to the Service

API Usage and Rate Limits

When using our API, you agree to:

• Respect rate limits and usage quotas
• Not abuse or overload the Service
• Keep your API tokens confidential
• Revoke compromised tokens immediately

We reserve the right to implement rate limits and usage restrictions to ensure fair access for all users.

Intellectual Property

The Service and its original content, features, and functionality are owned by MarleyFetch and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the content you send through the Service. You grant us a limited license to process and transmit your content solely for the purpose of providing the Service.

Google Sign-In

If you use Google Sign-In with MarleyFetch, that flow is also subject to Google's terms and policies:

• Google Privacy Policy

You agree to comply with Google's terms when using Google Sign-In with our Service.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Results obtained from the Service will be accurate or reliable

Limitation of Liability

IN NO EVENT SHALL MARLEYFETCH, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

Service Modifications and Termination

We reserve the right to:

• Modify or discontinue the Service at any time
• Suspend or terminate your access for violations of these Terms
• Change these Terms at any time

We will make reasonable efforts to notify you of significant changes to the Service or Terms.

Account Termination

You may terminate your account at any time by:

• Revoking access through your Google Account settings
• Removing your sending connections from the dashboard
• Contacting us to request account deletion

Upon termination, your right to use the Service will immediately cease, and we will delete your data in accordance with our Privacy Policy.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last updated" date at the top of these Terms. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
